Council held a public hearing on the following two ordinances:

 

1. Ordinance Approving Various Amendments to the Planning and Zoning Code

 

2. Ordinance Rezoning Real Property Known as Parcel No. 11054000161

     

Located Near the Intersection of Interstate 75 and State Route 63

from H-I   

Heavy Industrial Zoning District to C-2 General Commercial Zoning      

District 

 

APPROVAL OF THE MINUTES

 

The Council Minutes and Finance Committee Minutes of September 11,

2007 were approved.

 

OLD BUSINESS

 

EMERGENCY ORDINANCE NO. 2007-41. AN ORDINANCE AMENDING AND SUPPLEMENTING EXHIBIT "A" OF EMERGENCY ORDINANCE NO. 2006-55 TO ESTABLISH THE POSITIONS OF ASSISTANT TO THE CITY MANAGER, PLANNER, AND FIRE INSPECTOR, PROVIDE FOR A WAGE/SALARY RANGE FOR SAID POSITIONS, AND INCREASE THE AUTHORIZED NUMBER FOR INCOME TAX AUDITOR TO TWO, AND DECLARING AN EMERGENCY.

 

Council amended Emergency Ordinance No. 2007-41 to reflect the salary range for Assistant to the City Manager as $40,000 to $55,000 per year and the salary range for the Administrative Assistant as $32,500 to $42,500 per year.  Council adopted Emergency Ordinance No. 2007-41 as amended.

 

NEW BUSINESS

 

ORDINANCE NO.  2007-42.  AN ORDINANCE AMENDING AND SUPPLEMENT VARIOUS SECTIONS OF THE PLANNING AND ZONING CODE TO PROVIDE FOR THE DEFINITION OF LIGHT MANUFACTURING AND HEAVY MANUFACTURING, AMENDING THE SET BACK REQUIREMENTS IN AN A-1 AGRICULTURAL ZONING DISTRICT, ELIMINATION OF RESIDENTIAL PROPERTY AS BEING EXEMPT FROM SURFACE AND DRAINAGE REQUIREMENTS, ADDITION OF RECREATIONAL VEHICLES AS AN OPTION FOR EXCEPTIONS TO THE ASPHALTIC OR CONCRETE SURFACE REQUIREMENTS, ADDITION OF SPECIFIC REQUIREMENTS FOR LOCATING APARTMENTS AND BUSINESS AND COMMERCIAL SPACE, INCREASING THE MINIMUM SIDE YARD SETBACK IN AN R-2 SINGLE FAMILY RESIDENTIAL ZONING DISTRICT, GRANTING AUTHORITY TO THE ZONING ENFORCEMENT OFFICER FOR APPROVAL OF MINOR SUBDIVISIONS, REMOVAL OF CEMETERIES AS A CONDITIONAL USE IN A C-2 GENERAL COMMERCIAL ZONING DISTRICT, ADDITION OF BUFFERYARD REQUIREMENTS IN ANY INDUSTRIAL LAND USE, REMOVAL OF GREEN ASH, HESS ASH, AND FLOWERING ASH TREES IN THE LANDSCAPING AND BUFFERYARD REQUIREMENTS, AND CORRECTING THE INTERSECTION NAME OF HERITAGE GREEN DRIVE AND SR 63 FOR REAL ESTATE SIGNS.

 

Council approved the first reading of Ordinance No. 2007-42.

 

ORDINANCE NO. 2007-43. AN ORDINANCE REZONING REAL PROPERTY CONTAINING APPROXIMATELY 34.5 ACRES, MORE OR LESS, LOCATED AT THE INTERSECTION OF INTERSTATE 75 AND STATE ROUTE 63 AND FURTHER DESCRIBED HEREIN FROM H-I HEAVY INDUSTRIAL ZONING DISTRICT TO C-2 GENERAL COMMERCIAL ZONING DISTRICT.

 

Council approved the first reading of Ordinance No. 2007-43.

 

ORDINANCE NO. 2007-44. AN ORDINANCE SUPPLEMENTING CHAPTER 1414 OF THE BUILDING AND HOUSING CODE TO PROHIBIT OUTDOOR WOOD FIRED BOILERS.

 

Council approved the first reading of Ordinance No. 2007-44.

 

EMERGENCY ORDINANCE NO. 2007-45. AN ORDINANCE TERMINATING THE RURAL ENTERPRISE ZONE AGREEMENT WITH PRECISION PACKAGING & SERVICES, INC.

AND REQUESTING THAT THE BOARD OF COUNTY COMMISSIONERS OF BUTLER COUNTY ALSO TERMINATE THIS AGREEMENT, AND DECLARING AN EMERGENCY.

 

Council adopted Emergency Ordinance No. 2007-45.

 

RESOLUTION NO. 55-2007. A RESOLUTION CLARIFYING THE REMOVAL OF COMMUNITY REINVESTMENT AREAS CREATED IN 1986.

 

Council approved the first reading of Resolution No. 55-2007.

 

RESOLUTION NO. 56-2007. A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER INTO A COMMUNITY REINVESTMENT AREA AGREEMENT BY AND BETWEEN THE CITY OF MONROE AND GENERAL MOTORS CORPORATION BY AND THROUGH ITS GENERAL MOTORS SERVICE & PARTS OPERATIONS.

 

Council approved the first reading of Resolution No. 56-2007.

 

EMERGENCY RESOLUTION NO. 57-2007. A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR, AND DECLARING AN EMERGENCY.

 

Council adopted Emergency Resolution No. 57-2007.

 

EMERGENCY RESOLUTION NO. 58-2007. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH THE LOWEST AND/OR BEST BIDDER FOR THE SIDEWALK, CURB & GUTTER, DRIVE APRON, AND CATCH BASIN PROGRAM, AND DECLARING AN EMERGENCY.

 

Council adopted Emergency Resolution No. 58-2007.

 

EMERGENCY RESOLUTION NO. 59-2007. A RESOLUTION ACCEPTING THE DONATION OF A STAIRPRO STAIR CHAIR FROM THE BOARD OF TRUSTEES OF LEMON TOWNSHIP WITH THE VALUE OF TWO THOUSAND ONE HUNDRED FIFTY EIGHT DOLLARS, AND DECLARING AN EMERGENCY.

 

Council adopted Emergency Resolution No. 59-2007.

 

EMERGENCY RESOLUTION NO. 60-2007.  A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPLY FOR GRANT FUNDS FROM THE BEN ROETHLISBERGER FOUNDATION C/O THE GIVING BACK FUND, TO BE USED TOWARD THE PURCHASE AND EQUIPPING OF POLICE SERVICE DOGS, AND DECLARING AN EMERGENCY.

EMERGENCY RESOLUTION NO. 61-2007. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT BY AND BETWEEN THE CITY OF MONROE AND THE STATE OF OHIO, DEPARTMENT OF TRANSPORTATION, FOR THE RECONSTRUCTION OF INTERSTATE ROUTE 75 AND STATE ROUTE 63 SERVICE INTERCHANGE, INCLUDING WIDENING AND RECONSTRUCTION OF 2.76 MILES OF INTERSTATE ROUTE 75, 0.81 MILES OF STATE ROUTE 63, RECONSTRUCTION OF BRIDGE BUT-75-1091 OVER MASON ROAD ON INTERSTATE ROUTE 75, RECONSTRUCTION OF BRIDGE WAR-75-0093 OVER MILLER CREEK AND I & O RAILROAD ON INTERSTATE ROUTE 75, AND RECONSTRUCTION OF BRIDGE WAR-75-0170 OVER SHAKER CREEK ON INTERSTATE ROUTE 75, LYING WITHIN THE CITY OF MONROE, AND DECLARING AN EMERGENCY. 

 

Council adopted Emergency Resolution No. 61-2007.

 

EMERGENCY RESOLUTION NO. 62-2007. A RESOLUTION TO AUTHORIZE AND DIRECT THE CITY MANAGER TO ADVERTISE AND RECEIVE BIDS, ACCORDING TO LAW, FOR PHASE ONE CONSTRUCTION OF THE MONROE CROSSINGS PARK, AND

DECLARING AN EMERGENCY.

 

Council adopted Emergency Resolution No. 62-2007.

 

EMERGENCY RESOLUTION NO. 63-2007. A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN AGREEMENT BY AND BETWEEN THE CITY OF MONROE AND SMARTBILL FOR THE PREPARATION AND MAILING OF UTILITY BILLS, AND DECLARING AN EMERGENCY.

 

Council adopted Emergency Resolution No. 63-2007.

 

CONSIDERATION OF MOTION APPROVING THE EXPENDITURE OF $24,725 FOR A MOBILE COMPUTER SYSTEM FOR THE POLICE DEPARTMENT.

 

Council approved the expenditure of $24,725.
